After the recent housing market crash and flood of foreclosed properties, it soon became apparent that the long standing practice of including the terms of termite inspection into the Purchase Agreement was creating problems for Buyers.
These foreclosed properties were being sold at deep discounts, but sold "As-Is" by the Banks.
Buyers who were depending on a residential loan could not move forward when the Termite Report disclosed that the structure had wood destroying pest problems.
A buyer could not even legally go on to the property and correct these conditions without creating a liability risk to the Bank.

For those who prefer including the Termite Report in the escrow process, you must check the box in paragraph 7. A.(2) or 7. A.(3) of the Purchase Agreement and specify a Termite Report.
Paragraph 7 clearly specifies that "it does not determine who is to pay for any work recommended or identified in the Report, " only who is paying for the Report.
The buyer always has the option to order their own inspection even if the Seller has provided a report.

Condo/Townhome

A Termite Report on a Condominium or other common interest subdivision does have some challenges.
There is a conflict between the Structural Pest Control Act and the Residential Purchase Agreement.
The Purchase Agreement specifies that the Inspection be limited to the "separate interest and exclusive-use areas being transferred, and shall NOT include common areas."
Termite Companies are required by State Law to perform a complete inspection of the structure unless limitation is requested.
A complete inspection of a condominium includes the interior, exterior, attic space and substructure up to the point of common wall(s) of the unit.

PUD/Twin-Home
Report
A Termite Report on a PUD (most Twin-Homes are a PUD) is exactly the same as a single family residence if it is free standing, meaning there are no common walls or attachments to adjacent properties.
One difficulty may be that one or more of the structure walls may be built directly on the property line.
You will need to obtain permission, in advance, from the neighboring property owner to enter their yard for inspection of that exterior wall.
This permission will also need to be obtained if corrective work, such as a fumigation, is be performed.
